Overview

This one-day program was on the issue of family law, more specifically on the division of family patrimony and the main principles of the partnership of acquests.

Objectives

The objectives of this program were to enhance judges’ knowledge, in particular new judges, regarding the composition and the sharing of family patrimony and to help them to apply the necessary calculations when establishing the value of an asset and its partitionable value.

Summary

With the help of lectures but specifically based on practical case studies and interactive demonstrations by a teacher, an experienced family law practitioner, and experienced judges specialized in this domain, judicial participants learned how to understand and apply the following: the composition of the family patrimony, the qualification of assets that are part of the family patrimony (s. 415 C.c.Q.); establishing the value of an asset, its net value and its partitionable value; the concepts of contribution, added value, deductibles, re-investments and compensatory payment; and the main principles of the partnership of acquests.
